Terms of Service

These Terms govern your use of samuiscooterrental.com and any scooter rental booked through Koh Samui Scooter Rentals (operated as part of the Skoot platform). By booking with us you agree to these Terms.

The Rental Agreement

Each scooter rental is a contract directly between you (the renter) and the local partner rental shop in Koh Samui that owns and supplies the scooter. Skoot is not the owner of the scooter. Skoot's role is to facilitate the booking, verify the partner shop, hold your refundable deposit in escrow, and protect both parties if a dispute arises.

Deposit Escrow

Your refundable security deposit is paid to and held by Skoot — not by the rental shop. This protects you against the most common scooter rental scam in Thailand: shops inventing or exaggerating “damage” in order to keep a cash deposit or hold your passport. Any deduction from your deposit must first be reviewed and approved by Skoot. The shop must submit time-stamped before/after photographs and a written explanation, and you have the right to dispute the claim before any money changes hands. If we cannot fairly verify the damage, the deposit is returned to you in full.

Helmet and Licence Requirements

By Thai law, helmets are mandatory for both rider and passenger at all times — police enforce this with on-the-spot fines. Helmets are provided free with every rental. To legally ride a scooter in Thailand you must hold a valid motorcycle licence from your home country plus a valid International Driving Permit (IDP) with the motorcycle category endorsed. Riding without an IDP voids any travel insurance and is the single biggest reason claims are denied after an accident.

Liability

You are responsible for operating the scooter safely, obeying Thai traffic laws, and returning the scooter in the same condition you received it (fair wear and tear excepted). Neither the partner shop nor Skoot is liable for personal injury, third-party damage, lost belongings, or consequential losses arising from your use of the scooter. We strongly recommend comprehensive travel insurance that explicitly covers motorbike riding.

Cancellations

Bookings cancelled more than 24 hours before pickup are refunded in full. See your booking confirmation for full cancellation terms.

Governing Law

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute that cannot be resolved between the parties shall be subject to the exclusive jurisdiction of the Thai courts.
